These terms and conditions ("Terms") govern your access to and use of the website at citynestresidences.co.uk (the "Site") operated by City Nest Residences Ltd ("City Nest Residences", "we", "our", "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About us

2. Use of the Site

You agree that you will:

• use the Site only for lawful purposes and in accordance with these Terms;
• not use the Site in any way that breaches any applicable local, national or international law or regulation;
• not attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site;
• not introduce any viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful;
• not use the Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of or is linked to spyware, computer viruses or other malicious software.

We may suspend or withdraw availability of the Site at any time without notice.

3. Information on the Site

Content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. Any figures, illustrative yields, timelines, occupancy rates or income examples shown on the Site are indicative only and are not a guarantee of results. Actual outcomes will depend on the property, the local market and the terms of any agreement entered into.

Although we make reasonable efforts to update the information on the Site, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up to date.

4. Our services

Our property management services, including guaranteed rent arrangements and short let management, are provided under separate written agreements between City Nest Residences and the property owner. Nothing on the Site constitutes an offer capable of acceptance; any engagement will be governed by the specific terms of that written agreement.

We are a member of the Property Redress Scheme (membership number PRS059918) and are registered with the Information Commissioner's Office. We hold Public Liability and Professional Indemnity insurance appropriate to our activities. We are not a letting agent regulated by ARLA Propertymark and we do not hold client money on your behalf unless specifically agreed in writing. Guaranteed rent arrangements involve us taking a lease of your property; we do not act as your agent under those arrangements.

5. Bookings by guests

Where you make a booking as a guest through a third party platform (such as Airbnb or Booking.com), your booking is subject to that platform's terms and conditions in addition to our house rules provided with the booking.

6. Intellectual property

We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy, and may download extracts, of any page from the Site for your personal use, but you must not otherwise reproduce, distribute, modify or create derivative works of any content on the Site without our prior written consent.

7. Third party links and resources

The Site may contain links to third party websites and resources, including a booking page hosted by Calendly. Such links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

8. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

• use of, or inability to use, the Site; or
• use of or reliance on any content displayed on the Site.

In particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

11. Governing law and jurisdiction

These Terms, their subject matter and their formation are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
